1 - PREAMBLE

 

SAS ACAJOU offers its customers the opportunity to reserve hotel rooms on its website www.hotel-acajou.fr (hereinafter the “Site”, by e-mail at the following address: accueil @ hotel-acajou. fr, by phone at +33 (0) 4 68 89 96 69 or via various reservation websites (eg: booking.com).

The present general conditions of sale of HOTEL ACAJOU (hereinafter the “GTC”) define the rights and obligations of the parties within the framework of the reservation of rooms within the Hotel and of the other services offered by the company ACAJOU.

Any reservation supposes the Customer's acceptance without restriction or reservation of the GTC, either on the website at the time of the reservation by checking the box provided for this purpose, or on paper at the time of registration ("Check-in") .

The Customer declares to have obtained from the company ACAJOU all the necessary information on the Site and to have the full legal capacity allowing him to engage under the GTC.

 

2 - DEFINITION

 

In the remainder of the present, the terms below will have the following meaning:

"Confirmation of reservation": E-mail sent by the company ACAJOU to the Customer recapitulating the reservation made by the Customer and confirming its receipt.

“Booking confirmation”: Dematerialized document which summarizes the characteristics of the services reserved by the Customer, and by which he possibly enters his bank card number as part of a prepayment or a guarantee. Acceptance of the booking confirmation has the effect of contractually binding the Customer.

 

3 - RESERVATIONS

  1. The Customer acknowledges having taken cognizance of the nature, destination and booking methods of the services available on the Site and having requested and obtained the necessary and / or additional information to make his reservation in full knowledge of the facts. The Customer certifies the veracity and accuracy of the information transmitted.

 

  1. The Customer is solely responsible for his choice of services and their suitability to his needs, so that the responsibility of the company ACAJOU can not be sought in this regard.

 

  1. Other reservations:

  • Group reservations (four rooms and more) are only accepted against payment of a deposit of 30% of the amount of the stay. Payment of the deposit can be made: * Either by direct debit from a bank card: VISA, MASTERCARD, AMEX

 

  • Reservations for a number of less than four rooms are not subject to the payment of a deposit, but require the communication by the Customer of payment information by Visa, Mastercard or Amex bank card (name of the holder, number, date of validity, cryptogram)

          

  1. Stay at the Hotel at the Hotel ACAJOU

All reservations are personal and cannot under any circumstances be transferred to a third party, whether free of charge or against payment.

 

  1. Rooms are available from 2 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure, regardless of the time of arrival or departure, of the means of transport used, unless expressly provided otherwise. .

Otherwise, he will be billed for an additional night.

Depending on availability, the room may be kept until 2:00 p.m. on the day of departure, subject to payment of a supplement of 10 euros.

 

  1. Animals are accepted as long as they are kept on a leash or in a cage in the common areas of the establishment. In any case, the company ACAJOU reserves the right to refuse an animal that it considers to be dangerous or whose behavior would be likely to disturb the peace and comfort of Hotel Customers.

Price: € 10 per night and per animal.

 

  1. The Customer accepts and undertakes to use the room with due care. Also any behavior contrary to good morals and public order will lead the company ACAJOU to ask the Customer to leave the establishment without any compensation and or without any refund if a payment has already been made. In the event that no payment has yet been made, the Customer will have to pay the price of the nights spent before leaving the establishment.

 

  1. The Hotel offers free Wi-Fi access allowing Customers to connect to the Internet. The Customer undertakes that the computer resources made available to him by the Hotel are not in any way used for the purposes of reproduction, representation, making available or communicating to the public works or objects. protected by copyright or by a neighboring right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in books I and II of property intellectual property when this authorization is required. If the Customer does not comply with the aforementioned obligations, he would risk being accused of an offense of counterfeiting (article L.335-3 of the intellectual property code), punishable by a fine of 300,000 euros and three years' imprisonment. .

The Customer is also required to comply with the security policy of the Hotel's internet service provider, including the rules for the use of the means of security implemented in order to prevent the illicit use of resources. IT and to refrain from any act that undermines the effectiveness of these means.

 

  1. The general ban on smoking in hotels and restaurants has been applicable in France since 01/02/2008 in all public places and therefore applies within the Hotel and generally within the whole of the establishment of the company ACAJOU.

 

Smoking in the hotel exposes you to an additional charge of 90 € or to legal proceedings.

 

Any untimely triggering of the fire alarm for non-compliance with this provision will be invoiced € 150 for the cost of putting the fire safety system back into service.

 

4 - PRICE

 

  • The prices relating to the reservation of services are indicated before and during the reservation.

  • The prices indicated are per room for the number of person (s) and the date selected.

  • The prices are confirmed to the Customer in euros including tax.

  • All reservations, regardless of their origin, are payable in euros.

  • Tourist tax and additional services (breakfast, garage, additional bed, cot, pets, half board, full board, etc.) are not included in the price and are therefore to be paid directly to the hotel on site. .

  • The prices take into account the VAT applicable on the day of the order and any change in the rate applicable to VAT will be automatically reflected in the prices indicated on the date of invoicing.

  • Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the date of invoicing.

  • The company ACAJOU, will indicate the total amount of the reserved stay when confirming the Customer's reservation.

  • Certain promotional offers that may be available on the internet are sold exclusively on the internet and under no circumstances at the hotel reception.

 

5 - PAYMENT

 

  1. The Customer communicates his bank details as a guarantee of the reservation by credit or private bank card (Visa, Mastercard, American Express) indicating the card number, as well as its date of validity (it is specified that the bank card used must be valid at the time of stay) and the visual cryptogram as part of a prepayment.

He must present himself at the Hotel with the bank card which allowed him to guarantee the reservation or to make the prepayment or payment of the deposit.

The Hotel will take a copy and can check the Client's solvency. The Customer will also be asked to present an identity document for the purposes of preventing credit card fraud, of which the Hotel will take a copy, which the Customer accepts without reservation.

  1. Payment is debited at the Hotel during the stay, except in the case of special conditions or rates where payment is debited when booking (online prepayment on certain rates). This prepayment is called a deposit. In the case of a non-prepaid online rate, the Hotel may ask the Customer, upon arrival, for a security deposit or an authorization to debit the credit card, in order to guarantee payment of the sums corresponding to the services. consumed on site.

  2. In the event of a no show (reservation not canceled - customer not present) of a reservation guaranteed by credit card, the Hotel will debit the customer, as a lump sum, for the amount of the entire stay on the credit card that has been given as a reservation guarantee.

  3. If the Customer reserves several rooms but the prepayment is only necessary for one room for example, in this case, the payment card that is used makes it possible to pay the room concerned by the prepayment and the payment card that will have been seizure will serve as a guarantee for the other rooms.

  4. At the time of prepayment, the amount which is debited during the reservation includes: the price of accommodation, the price of catering if breakfast is chosen, and all other additional services selected by the Customer.

  5. In the case of a rate subject to online prepayment, the amount paid in advance is debited at the time of booking.

  6. Any missing equipment (for example: towels, bath towel, pillows, etc.) will be billed to the Customer and debited according to the terms in the paragraph below.

  7. The Customer expressly and irrevocably authorizes the company ACAJOU to debit the bank card whose references have been communicated to it by the Customer in order to pay all sums due for the stay, including the cost of repairs and repairs. of any damage, breakage, theft, etc ... attributable to the Customer and / or to the persons accompanying him

 

6 - FILOUTERY

Filouterie is an offense characterized by the fact of consuming a paid good or service:

  • by knowing that you are unable to pay or by being deliberately determined not to pay,

  • while pretending to be willing to pay.

 

Filouterie is punished by six months imprisonment and a fine of € 7,500 in addition to damages.

 

7 - RESPONSIBILITY

 

The photographs presented on the Site / Brochures / Displays are not contractual. Even if every best effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as exact an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture. or possible renovations.

 

8 - DEGRADATION / NUISANCE

 

We ask our customers to respect the premises as well as the room as a whole. In the event of degradation, the Customer will have to engage his civil liability.

In case of loss of the key allowing access to the room, the repair will be invoiced 20 €.

To respect other Customers, be careful not to slam the doors or make too much noise, especially between 10 p.m. and 8 a.m.
Any neighborhood noise related to the behavior of a person or an animal under his responsibility, may lead the hotelier to invite the customer to leave the establishment, since the noise generated is likely to affect the peace customers (art. R.1334-30 and R.1334-31 of the Public Health Code).

 

9 - RESPECT FOR PRIVACY

 

  1. The Customer is informed, on each of the online forms for the collection of personal data, of the mandatory or optional nature of the responses by the presence of an asterisk. Optional requests for information are intended to better understand and improve the services offered.

  2. In the absence of information identified as mandatory, the Company ACAJOU may not be able to register a reservation and manage the latter's complaints.

  3. As part of pre-contractual measures for the reservation or the execution of the reservation contract, they may, each as far as they are concerned, be recipients of identity data, personal and professional life data, information of an economic and financial nature, in particular for the purposes of hotel reservations and management of complaints, but for exclusively non-commercial purposes, which the Customer declares to have read and accepted.

  4. The Customer has the right to access, modify, rectify and delete data concerning him. To exercise this right, all you have to do is contact the company ACAJOU, to make a request to the postal and electronic addresses mentioned at the top of these GTC.

  5. The processing of personal data has been declared to the Commission Nationale Informatique et Libertés.

 

10 - AGREEMENT ON PROOF

 

The entry or delivery of the required banking information, as well as the acceptance of these general conditions and of the reservation voucher or request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

 

11 - RELEASE

 

In the event of non-availability of the Hotel, of a technical problem in the Hotel, of work or for any other reason, except in cases of force majeure, the latter will make its best efforts to have the Participants fully or partially accommodated in a another hotel for services of the same nature and of the same quality.

 

12 - SETTLEMENT OF DISPUTES

  1. The Customer is informed by HOTEL ACAJOU of the possibility of having recourse, in the event of a dispute relating to these general conditions, to a conventional mediation procedure or to any other alternative mode of dispute settlement.

  2. Complaints relating to non-performance or improper performance of hotel services must, under penalty of foreclosure, be brought to the attention of HOTEL ACAJOU in writing within eight days after the date of departure from the hotel directly to the hotel or at the contact details of the Customer Service indicated at the head of these T & Cs.

 

13 - APPLICABLE LAW - LANGUAGE - COMPETENT COURT

 

These General Conditions of Sale are governed by French law. Only the French language version of these General Conditions is valid. In the event of a persistent dispute, exclusive jurisdiction is given to the courts within the jurisdiction of the Tribunal de grande instance of Lyon, including in summary proceedings.

 

14 - INTEGRALITY

 

  1. These T & Cs and the booking voucher or request express all the obligations of the parties.

  2. No general or specific condition communicated by the Customer may be incorporated into these general conditions.

  3. The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation voucher or request (including the special conditions of the reserved rate) and these GTC.

  4. In the event of a contradiction between the booking voucher and the GTC, the provisions appearing on the booking voucher will be the only ones applicable for the obligation in question.

 

15 - EVOLUTION / MODIFICATION OF THE GENERAL CONDITIONS OF SALE

 

These T & Cs may be modified and / or supplemented at any time by the company ACAJOU. In this case, the new version of the general conditions of sale will be put online by the company ACAJOU. As soon as it is posted on the internet, the new version of the GTC will automatically apply to all Customers.

 

IN THE EVENT OF NON-COMPLIANCE BY THE CUSTOMER WITH ANY OF THESE CONDITIONS, THE HOTEL MANAGER WILL BE OBLIGED TO INVITE THE CUSTOMER TO LEAVE THE ESTABLISHMENT IMMEDIATELY WITHOUT ANY INDEMNITY.
