
Terms of Sales
1 - PREAMBLE
SAS ACAJOU offers its customers the opportunity to reserve hotel rooms on its website www.hotel-acajou.fr (hereinafter the “Site”, by e-mail at the following address: accueil @ hotel-acajou. fr, by phone at +33 (0) 4 68 89 96 69 or via various reservation websites (eg: booking.com).
The present general conditions of sale of HOTEL ACAJOU (hereinafter the “GTC”) define the rights and obligations of the parties within the framework of the reservation of rooms within the Hotel and of the other services offered by the company ACAJOU.
Any reservation supposes the Customer's acceptance without restriction or reservation of the GTC, either on the website at the time of the reservation by checking the box provided for this purpose, or on paper at the time of registration ("Check-in") .
The Customer declares to have obtained from the company ACAJOU all the necessary information on the Site and to have the full legal capacity allowing him to engage under the GTC.
2 - DEFINITION
In the remainder of the present, the terms below will have the following meaning:
"Confirmation of reservation": E-mail sent by the company ACAJOU to the Customer recapitulating the reservation made by the Customer and confirming its receipt.
“Booking confirmation”: Dematerialized document which summarizes the characteristics of the services reserved by the Customer, and by which he possibly enters his bank card number as part of a prepayment or a guarantee. Acceptance of the booking confirmation has the effect of contractually binding the Customer.
3 - RESERVATIONS

The Customer acknowledges having taken cognizance of the nature, destination and booking methods of the services available on the Site and having requested and obtained the necessary and / or additional information to make his reservation in full knowledge of the facts. The Customer certifies the veracity and accuracy of the information transmitted.

The Customer is solely responsible for his choice of services and their suitability to his needs, so that the responsibility of the company ACAJOU can not be sought in this regard.

Other reservations:

Group reservations (four rooms and more) are only accepted against payment of a deposit of 30% of the amount of the stay. Payment of the deposit can be made: * Either by direct debit from a bank card: VISA, MASTERCARD, AMEX

Reservations for a number of less than four rooms are not subject to the payment of a deposit, but require the communication by the Customer of payment information by Visa, Mastercard or Amex bank card (name of the holder, number, date of validity, cryptogram)
2. Stay at Hôtel Acajou

All bookings are personal and non-transferable and may not be assigned to a third party, whether free of charge or for a fee.

Rooms are available from 3:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure, regardless of arrival or departure time or the means of transport used, unless expressly stated otherwise.

Failing this, an additional night will be charged.

Subject to availability, the room may be kept until 1:00 PM on the day of departure for an additional fee of €10.

Dogs are accepted provided they are kept on a leash or in a carrier in the common areas of the property. In all cases, ACAJOU reserves the right to refuse any animal considered dangerous or whose behavior may disturb the peace and comfort of the hotel’s guests. Dogs are not allowed on the beds or on the sheets and towels provided in the rooms.

Rate: €5 per night per dog, with a €50 deposit refunded after the check-out inspection
The Customer accepts and undertakes to use the room with due care. Also any behavior contrary to good morals and public order will lead the company ACAJOU to ask the Customer to leave the establishment without any compensation and or without any refund if a payment has already been made. In the event that no payment has yet been made, the Customer will have to pay the price of the nights spent before leaving the establishment.
The Hotel offers free Wi-Fi access allowing Customers to connect to the Internet. The Customer undertakes that the computer resources made available to him by the Hotel are not in any way used for the purposes of reproduction, representation, making available or communicating to the public works or objects. protected by copyright or by a neighboring right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in books I and II of property intellectual property when this authorization is required. If the Customer does not comply with the aforementioned obligations, he would risk being accused of an offense of counterfeiting (article L.335-3 of the intellectual property code), punishable by a fine of 300,000 euros and three years' imprisonment. .
The Customer is also required to comply with the security policy of the Hotel's internet service provider, including the rules for the use of the means of security implemented in order to prevent the illicit use of resources. IT and to refrain from any act that undermines the effectiveness of these means.
The general ban on smoking in hotels and restaurants has been applicable in France since 01/02/2008 in all public places and therefore applies within the Hotel and generally within the whole of the establishment of the company ACAJOU.
Smoking in the hotel exposes you to an additional charge of 90 € or to legal proceedings.
Any untimely triggering of the fire alarm for non-compliance with this provision will be invoiced € 150 for the cost of putting the fire safety system back into service.
4 - CANCELLATION
Hôtel Acajou offers two options:
- Non-refundable option:
For any cancellation made between the booking date and 3 days before arrival (before 7:00 PM), no cancellation fee will be charged.
For any cancellation made between 3 days before arrival (before 8:00 PM) and a no-show, the first night will be charged.

Cancellation insurance option:
For any cancellation made between the booking date and 1 day before arrival (before 8:00 PM), only the cancellation insurance fee of €5 will be charged.
For any cancellation made between 1 day before arrival (before 8:00 PM) and a no-show, the total amount of the booking will be charged.
5 - PRICES
Prices related to the booking of services are indicated before and during the booking process.
The prices shown are per room, for the selected number of guest(s) and dates.
Prices are confirmed to the guest in euros, including VAT.
All reservations, regardless of their origin, must be paid in euros.
Tourist tax and additional services (breakfast, extra bed, baby cot, pets, breakfast) are not included in the price and must be paid separately at the hotel.
Prices include the VAT rate applicable on the day of booking. Any change in the VAT rate will automatically be applied to the prices shown at the time of billing.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will also be automatically applied to the prices shown at the time of billing.
ACAJOU will indicate the total amount of the booked stay when the reservation is confirmed.
Some promotional offers available online are sold exclusively online and are not available at the hotel reception.
6 - PAYMENT
Payment is accepted only by bank card (Visa or Mastercard). American Express cards are not accepted. A valid bank card is required to guarantee and confirm your reservation, and it must remain valid throughout the entire stay.
The total amount of the stay will be automatically charged 3 days before your arrival to the bank card provided at the time of booking. If the payment is declined, the reservation will be cancelled, as only a valid bank card can guarantee your stay.
Upon arrival, you may be asked to present the bank card used for the reservation as well as an ID document, as part of fraud prevention measures.
In the event of a no-show, if the booking has not been cancelled within the applicable deadlines, the first night will be charged as a penalty to the bank card provided.
In case of an extension of your stay on site, payment may be made in cash directly at the hotel.
The guest expressly authorizes Hôtel Acajou to charge the bank card provided for any outstanding amount due for the stay, as well as, where applicable, for any costs related to damage, theft, breakage, or missing items noted after departure.
7 - FILOUTERY
Filouterie is an offense characterized by the fact of consuming a paid good or service:

by knowing that you are unable to pay or by being deliberately determined not to pay,

while pretending to be willing to pay.
Filouterie is punished by six months imprisonment and a fine of € 7,500 in addition to damages.
8 - RESPONSIBILITY
The photographs presented on the Site / Brochures / Displays are not contractual. Even if every best effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as exact an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture. or possible renovations.
9 - DEGRADATION / NUISANCE
We ask our customers to respect the premises as well as the room as a whole. In the event of degradation, the Customer will have to engage his civil liability.
In case of loss of the key allowing access to the room, the repair will be invoiced 20 €.
To respect other Customers, be careful not to slam the doors or make too much noise, especially between 10 p.m. and 8 a.m.
Any neighborhood noise related to the behavior of a person or an animal under his responsibility, may lead the hotelier to invite the customer to leave the establishment, since the noise generated is likely to affect the peace customers (art. R.1334-30 and R.1334-31 of the Public Health Code).
10 - RESPECT FOR PRIVACY

The Customer is informed, on each of the online forms for the collection of personal data, of the mandatory or optional nature of the responses by the presence of an asterisk. Optional requests for information are intended to better understand and improve the services offered.

In the absence of information identified as mandatory, the Company ACAJOU may not be able to register a reservation and manage the latter's complaints.

As part of pre-contractual measures for the reservation or the execution of the reservation contract, they may, each as far as they are concerned, be recipients of identity data, personal and professional life data, information of an economic and financial nature, in particular for the purposes of hotel reservations and management of complaints, but for exclusively non-commercial purposes, which the Customer declares to have read and accepted.

The Customer has the right to access, modify, rectify and delete data concerning him. To exercise this right, all you have to do is contact the company ACAJOU, to make a request to the postal and electronic addresses mentioned at the top of these GTC.

The processing of personal data has been declared to the Commission Nationale Informatique et Libertés.
11 - AGREEMENT ON PROOF
The entry or delivery of the required banking information, as well as the acceptance of these general conditions and of the reservation voucher or request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
12- RELEASE
In the event of non-availability of the Hotel, of a technical problem in the Hotel, of work or for any other reason, except in cases of force majeure, the latter will make its best efforts to have the Participants fully or partially accommodated in a another hotel for services of the same nature and of the same quality.
13 - SETTLEMENT OF DISPUTES

The Customer is informed by HOTEL ACAJOU of the possibility of having recourse, in the event of a dispute relating to these general conditions, to a conventional mediation procedure or to any other alternative mode of dispute settlement.

Complaints relating to non-performance or improper performance of hotel services must, under penalty of foreclosure, be brought to the attention of HOTEL ACAJOU in writing within eight days after the date of departure from the hotel directly to the hotel or at the contact details of the Customer Service indicated at the head of these T & Cs.
14 - APPLICABLE LAW - LANGUAGE - COMPETENT COURT
These General Conditions of Sale are governed by French law. Only the French language version of these General Conditions is valid. In the event of a persistent dispute, exclusive jurisdiction is given to the courts within the jurisdiction of the Tribunal de grande instance of Lyon, including in summary proceedings.
15- INTEGRALITY

These T & Cs and the booking voucher or request express all the obligations of the parties.

No general or specific condition communicated by the Customer may be incorporated into these general conditions.

The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation voucher or request (including the special conditions of the reserved rate) and these GTC.

In the event of a contradiction between the booking voucher and the GTC, the provisions appearing on the booking voucher will be the only ones applicable for the obligation in question.
16 - EVOLUTION / MODIFICATION OF THE GENERAL CONDITIONS OF SALE
These T & Cs may be modified and / or supplemented at any time by the company ACAJOU. In this case, the new version of the general conditions of sale will be put online by the company ACAJOU. As soon as it is posted on the internet, the new version of the GTC will automatically apply to all Customers.
IN THE EVENT OF NON-COMPLIANCE BY THE CUSTOMER WITH ANY OF THESE CONDITIONS, THE HOTEL MANAGER WILL BE OBLIGED TO INVITE THE CUSTOMER TO LEAVE THE ESTABLISHMENT IMMEDIATELY WITHOUT ANY INDEMNITY.
